USER TERMS AND LEGAL AND OTHER INFORMATION

International Macular and Retinal Foundation web-site, any newsletters, materials or other forms of communications (collectively referred to as the “Sites”) are accessible worldwide to anyone with Internet access.  Any access to the Sites is subject to the User Terms and conditions set forth herein (“User Terms”).  In addition, use of the Sites is also subject to all applicable copyright and trademark laws, and all other applicable laws, regulations, directives and codes.  BY YOUR ACCESS TO, AND USE OF, THE SITES, YOU ACCEPT ALL OF THE TERMS AND CONDITIONS SET FORTH IN THE SITES, INCLUDING, WITHOUT LIMITATION, THESE USER TERMS AND THE TERMS OF International Macular and Retinal Foundation ‘s PRIVACY POLICY, WITHOUT ANY EXCEPTIONS AND WITHOUT ANY QUALIFICATIONS TO ALL SUCH TERMS AND CONDITIONS.  International Macular and Retinal Foundation reserves the right to amend these terms and conditions at any time, and from time to time, by posting such amended terms in lieu of the current User Terms.  By accessing International Macular and Retinal Foundation’s Sites subsequent to the date of adoption of any such amended User Terms, you are automatically deemed to have accepted any such amendments to the User Terms.

International Macular and Retinal Foundation’s SITE IS PROVIDED ON AN ‘AS-IS’ BASIS WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  International Macular and Retinal Foundation SHALL NOT BE LIABLE FOR ANY LOSS OR INJURY OR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR SIMILAR DAMAGES REGARDING YOUR ACCESS TO OR USE OF THE SITES AND THE INFORMATION AVAILABLE ON SERVICE AND THE SITES OR ARISING OUT OF ANY ACTION TAKEN IN RESPONSE TO OR AS A RESULT OF ANY INFORMATION AVAILABLE ON THE SERVICES AND THE SITES.  NOTHING CONTAINED ON THE SITES SHALL BE CONSTRUED AS PROVIDING MEDICAL OR HEALTH CARE ADVICE, NOR IS THE INFORMATION INDENDED TO BE USED FOR MEDICAL DIAGNOSIS OR TREATMENT OR AS A SUBSTITUTE FOR CONSULTATION WITH A QUALIFIED HEALTH CARE PROVIDER.  NEVER DISREGARD MEDICAL ADVICE OR DELAY IN SEEKING IT BECAUSE OF SOMETHING YOU HAVE READ ON THE SITES.

Visual tests offered at the Sites have not been approved by the Food and Drug Administration (“FDA”).

Visual tests offered at the Sites are under clinical testing and technical development, and therefore can be anticipated to change and improve over time. We will make every effort to maintain your historical test results, but significant changes to the design of our tests may result in a requirement for you to take a new baseline test.

If you are participating in a clinical study, in order to protect your personal identity, we recommend that you not use your own name or any other personal identifier, but instead only use the log-in information provided to you by the sponsor of the clinical study.  If you are in a clinical study and also wish to open your own separate personal account, you may do so.

Use by you of any data from any links contained within the Sites is at your sole discretion, and International Macular and Retinal Foundation assumes no responsibility for the content on such third-party sites.

International Macular and Retinal Foundation may make changes to the Sites, information contained therein, software, documents, publications, prices, specifications, service offerings and any other information and materials within the Sites at any time and without prior notice.  Any such changes shall become effective, immediately upon posting to the Sites.

You shall not use the Sites for any purpose that is unlawful or prohibited by these User Terms.  You shall not take any action that shall disable, overburden or impair or otherwise damage any International Macular and Retinal Foundation’s server or network or host server, or otherwise interfere with any party’s use and enjoyment of the Sites.   You shall not attempt to “hack”, password mine, or otherwise gain unlawful access to services, materials, accounts, computer systems or networks connected to any server or to the Sites.

PRIVACY POLICY This Privacy Policy describes the types of information that International Macular and Retinal Foundation (“International Macular and Retinal Foundation” or “Company”) may collect from you when you visit our web-site and also explains how the Company may use that information.  In some cases, the information you provide may include personally identifiable information (“Personal Data”) that International Macular and Retinal Foundation obtains when you access and use the web-site and when you use content or other services on this web-site.  International Macular and Retinal Foundation takes its obligations with respect to use and protection of Personal Data very seriously and therefore hopes that the information set forth in this Privacy Policy will be helpful to you. Registration:  In order to become a registered user of this web-site, International Macular and Retinal Foundation requires you, its users, to provide your name, address, gender, date of birth, email address and certain healthcare information regarding the history of your eye care or medical conditions potentially impacting the treatment of your eyes.

You may also elect to register to receive periodic newsletters through registration, as well.

Surveys and Questionnaires:  From time to time, International Macular and Retinal Foundation may ask you for contact and demographic information.  Examples of the types of Personal Data that may be requested could include name, address, email address, gender, date of birth or age, income and healthcare information.  Your Personal Data from such surveys and questionnaires may be used to contact you as appropriate.  If you are contacted and do not wish to receive future mailings or other forms of communication, you may opt-out of receiving such further communications by following the process described below in the section entitled “Choice and Opt-Out”.

Contests:  International Macular and Retinal Foundation may run Contests from time to time on its web-site.  Personal information, such as that mentioned above under “Surveys and Questionnaires” may be collected.  Each such Contest will also set forth all the terms and rules governing the contest, and you should carefully review the rules of each such Contest before enrolling as a contestant. LogFiles:  As is true of most web-sites, International Macular and Retinal Foundation obtains certain information automatically and stores it in log files.  This information typically includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, the number and frequency of visits by users, operating system, date/time stamp and click stream data, as well as any other data as International Macular and Retinal Foundation may in the future consider appropriate for purposes of operating this web-site in a manner that will enable it to effectively manage this web-site and offer the services that it now, or in the future, offers to its users.  Further details are set forth below in Section 2.

Cookies and Other Technology:  When you visit this site, information about your browser type, operating system, IP address, ISPL and certain other related data is collected.  In addition, we may collect information about your browsing behavior, such as the number of times you have visited the site, the date and time you visited the site and the amount of time you spent on the site International Macular and Retinal Foundation  may also track your response to advertisements, email and site content, determine your ability to receive html-based email messages, learn how many users open an email and allow our service providers and other authorized third parties to compile aggregated statistics about certain advertising or email campaigns, contents or other similar events.  This information is used for internal purposes to manage the web-site and improve its functionality, as well as to assist in better targeting interactive advertising by the Company or its authorized service providers or other third parties.  The collection of all such data will be subject to the terms of this Privacy Policy.

Transparent GIF Files:  In addition to our own cookies, we may use pixels, or transparent GIF files, on our web-site to help manage online advertising and email marketing. These GIF files are provided by one or more third-party service providers, based on our specification as to where they are used. Otherwise, International Macular and Retinal Foundation will use such Personal Data to answer your questions, resolve an issue, and provide services or information that might potentially be of interest to you, either directly or through authorized third parties or service providers.  In addition, if you provide Personal Data in order to obtain access to certain services available through the Site, we will use your Personal Data to provide access to such services and to monitor your use of     such services.  Out of respect for your privacy, if you do not wish to receive some or all such forms of communication sent to you, you always have the option not to receive these communications.  Please see “Choice and Opt-Out” below.  You also have the right to have your name deleted from our mailing lists, by contacting us, as described below.  If we intend to use any Personal Data in any manner not consistent with this Privacy Policy, you will be informed of such anticipated use and shall have the opportunity to “opt-out” of such intended use.  For residents of European countries, you will always be     required to “opt-in” when providing Personal Data, and you will always have the right to subsequently “opt-out”, as referred to in this Section 3. Our Disclosure of Your Personal Data and Other Information You Provide:

The Personal Data and other information that International Macular and Retinal Foundation collects from you is collected so that we might better service you and your needs.  There are circumstances in which the Company may share your Personal Data with third parties without further notice to you.  These are set forth below.

Business Transfers:  If International Macular and Retinal Foundation should elect to sell its business or assets, whether as a result of a sale, merger, reorganization, dissolution or similar event, Personal Data and other information collected on our web-site may be transferred as part of such event.  We will certainly, as part of such transaction, ask the acquirer or survivor organization, to either maintain the key elements of this Privacy Policy or to advise you of any material changes that may affect the Personal Data and other information you have provided to Open Innovators on its web-site.

Related or Affiliated Companies:  International Macular and Retinal Foundation may share the Personal Data and  other information you provide to it with its related or affiliated companies, if any, all consistent with the terms set forth in this Privacy Policy. Such information may be used to contact you about potential services or products that may possibly be of interest     to you, as well as or other general purposes.  Any related or affiliated company, in receiving information from International Macular and Retinal Foundation, will be subject to the terms and conditions of this Privacy Policy.

Service Providers, Consultants, Agents or Other Third Parties (“Third Parties”):  International Macular and Retinal Foundation may from time to time use the service of Third Parties.  Such Third Parties may be used to provide mailing services, maintain or administer this web-site, manage surveys or questionnaires; sponsor contests or advertising on this web-site, provide information about services or products that may potentially be of interest to you and for such other and further related purposes.  Notwithstanding the foregoing, no personally identifiable healthcare information will be shared with any third party unless it is required and not until a Business Associate’s Agreement is signed, as required under the terms of the Health Insurance Portability and Accountability Act.  Except as expressly set forth in this Privacy Policy, no other use or disclosure shall be permitted.

Disclosures Required by Law:  We reserve the right to disclose your Personal Data and other information you have provided to us as may be required by law and when we believe that such disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order or legal process.

Changes in Personal Data or Changes in Preferences: If any of your Personal Data changes, you may edit the Personal Data appearing in your registration profile.  Also, if you wish to rescind a prior authorization to receive a newsletter, you may simply select “Reply” when you receive the newsletter and, in the subject line, insert, “Unsubscribe”.  Within thirty (30) days of receipt of an “Unsubscribe” request, your name shall be deleted from the distribution or mailing list.

Third-Party Ad Services: Third-party service providers may be used on this web-site to display advertising for our third-party advertisers.  These third parties may ask you to provide to them Personal Data, whether in registering you for contests or special offers.  Such Personal Data is not provided to this web-site but rather is being provided directly to that third party. Therefore, the Personal Data is not subject to this policy.  International Macular and Retinal Foundation does, however, require that such third-parties not collect Personal Data from you in any way other than as they disclose to you.

Links and Third-Party Web-sites: This Privacy Policy applies only to this web-site.  This site includes links to other web-sites, including access to content, products and services of such other non-affiliated or affiliated sites.  In some cases, these other sites are made available via “seamless experience” technology, and may appear to be part of our web-site.  Although some of the entities controlling these sites may be under contract with International Macular and Retinal Foundation, we urge you to familiarize yourself with the individual privacy and other terms for each linked web-site prior to submitting your Personal Data.

Children: International Macular and Retinal Foundation is concerned about the safety of children when they use the internet, and will never knowingly collect Personal Information from minors (children under 13 years of age, or any other age defined under applicable law) [without prior verifiable parental consent].  If we become aware that a minor is attempting to or has submitted Personal Data via this web-site, we will notify the user that we may not accept his or her Personal Data.  We will then remove any such Personal Data from our records.

Protection of Your Personal Data and Other Information: International Macular and Retinal Foundation takes seriously the protection of the information that it collects International Macular and Retinal Foundation therefore implemented appropriate administrative, organizational and technical safeguards intended to reduce the risk of accidental destruction or loss, or the unauthorized disclosure, access to, or use of such information, all as appropriate to the nature of the data concerned.

Choice and Opt-Out; Europeans and Opt-In: Unless you are a resident of a European country, in which case, we provide you with the opportunity to “opt-in” as to sharing of Personal Data, otherwise, we provide you with the opportunity to “opt-out” of having your Personal Data used for certain purposes, or if you no longer wish to receive promotional or other communications, you can indicate your preference on our email communications by simply replying “Unsubscribe”.  You may also contact us by mail, as further described below, under “Questions”.

Amendment of Privacy Policy: International Macular and Retinal Foundation reserves the right, from time to time, to amend the terms of this Privacy Policy by posting the amended Privacy Policy on this web-site.  If we make any material changes to this Privacy Policy that affect our treatment of your Personal Data, we will provide you with email or postal mail notice and a choice to opt in under the terms of the revised Privacy Policy.  After the changes take effect, any newly collected Personal Data will be subject to the terms of the revised Privacy Policy and all previously collected Personal Data will be handled in accordance with your response to our opt-in notice (in accordance with the revised policy if you opt-in and in accordance with the previously policy if you do not opt-in).
